At 4 pm, May 30th, Dan Foley delivered the answering brief to the state's appeal (he had 40 days to respond to the state's brief, and delivered the brief about a week early). One observer who read the brief this weekend called it brilliant. Foley is more modest: "you would have to be a lawyer to appreciate it."
The state now has 10 days to make a final response. Already the
Attorney General is asking for an extension of an extra week
over the ten days (again!!!!!!).
After the state makes its final response, it's up to the judges. The judges may call for additional, brief oral arguments at their own discretion. Stay tuned!
Foley and co-counsel Evan Wolfson of LLDEF have worked and re-worked
this brief non-stop since they had the state's initial
brief in hand. That of course costs money!!!
